In Greene County district Kegan Rowdy Steven Claiser, 24, of Ogden was sentenced Feb. 16 to 180 days in jail after he changed his plea to guilty to a charge of operating while intoxicated. All but two days of the jail time was suspended and he was placed on probation to Boone/Greene County Probation for one year. In lieu of the jail time he may complete the Des Moines Area Community College 48-hour alcohol education program. He must undergo a substance abuse evaluation and complete any recommended treatment at his own expense. Claiser was fined $1,250 with a $187.50 surcharge; one-half will be waived if he obtains a temporary restricted license. He must pay restitution not to exceed $600 for his court appointed attorney’s fees. Court costs were $100. Sentencing: Honorable Joseph B. McCarville
Bryce Aaron Smith, 42, of Shenandoah was sentenced to one year in jail after he changed his plea to guilty to a charge of OWI- second offense. All but seven days of the jail term was suspended and he was placed on probation for one year to Boone/Greene County Probation. He may complete the DMACC 96-hour alcohol education program in lieu of four days of the jail time. He must undergo a substance abuse evaluation and complete any recommended treatment at his own expense. Smith was fined $1,875 with a $281.25 surcharge. He must pay restitution not to exceed $600 for his court appointed attorney’s fees. Court costs were $300. Sentencing: McCarville
Kent Eugene Peninger, 61, of Jefferson was sentenced to one year in jail after he changed his plea to guilty to a charge of possession of methamphetamine- second offense. The jail term was suspended and he was placed on probation to Boone/Greene County Probation for one year. He must undergo a substance abuse evaluation and complete any recommended treatment at his own expense. Peninger was fined $430 with a $64.50 surcharge; both were suspended. He must pay restitution not to exceed $600 for his court appointed attorney’s fees. Court costs were $100. Sentencing: McCarville
A charge of possession of marijuana against Kaylin Aaliyah Small, 21, of Jefferson was dismissed. She must pay $100 court costs. Small was granted a deferred judgment in a companion case in magistrate court in which she was charged with possession of drug paraphernalia. She was placed on informal probation to the Greene County sheriff for one year and must pay a $105 civil penalty. She must also pay $300 restitution for her court appointed attorney’s fees and $60 courts costs. Sentencing: McCarville
Anthony Joseph Nunez, 55, of Jefferson was sentenced to 30 days in jail after he changed his plea to guilty to a charge of domestic abuse assault causing injury or mental illness. All but two days of the jail time was suspended and he was placed on probation for one year to Boone/Greene County Probation. He must complete the Iowa domestic abuse program at his own costs. Nunez was fined $430 with a $64.50 surcharge and a $90 domestic abuse surcharge. He must pay restitution for his court appointed attorney not to exceed $600 and $131.50 court costs. Melinda Sue Caruth, 48, of Boone was granted a deferred judgment after she changed her plea to guilty to a charge of fraudulent practice- third degree. She was placed on probation to Boone/Greene County Probation for one year. She must pay a $855 civil penalty and $140 court costs. A charge of gambling- avoid setoff was dismissed. Persons pleaded not guilty at arraignment as follows: Eric Christopher Rosenow, 39, of Jefferson, possession of methamphetamine- third offense and possession of marijuana; Benjamin Kenneth Johnston, 19, of Grand Junction, supply alcohol to person under legal age- serious injury and theft- fourth degree; Travis Scot Clark, 33, of Denison, driving while license barred; Nikki Kay Henderson, 61, of Jefferson, possession of controlled substance- prescription, possession of methamphetamine, possession of marijuana, and unlawful possession of prescription drug; and Edward Kanneh, 22, of Altoona, domestic abuse assault impeding blood/air flow. A trial date was set for April 4 for Johnston, and for May 9 for all other defendants named.
Information is available since the return of an arrest warrant that Jason M. Pirie, 41, of Callender has been charged with fraudulent practice- second degree and gambling- avoid setoff.
